    I’m fucking fuming!
    Some fucker has stolen my banner, logo and design

    and I believe they have stolen seller’s photos before.

    Does anyone have any advise?
    I’ve already sent them an abuse email.

    I think its disgusting. They have blatantly stolen your banner then amended it with their own site name!!!! I emailed them as well. What a bunch of TOSSERS.

    I would have already contacted their hosting provider Serena – thieves deserve everything they get. Report them!!!!!!!!! – assholes!!

    The hosting provider told me I should report this to the police as there is nothing they can do to prove who’s material is who’s.

    It looks as though nastyknicks, pantypost, and the tgp are all by the same people. The pantypost site was interesting…seems vaguely familiar but I can’t quite put my finger on it. :blink:

    I couldn’t believe it when I saw your banner Serena. I truely hope that you can sort this out, we can all vouch for you here. I just hate people that steal!

    I did have a browse of the photos on their site but don’t recognize any as being ours…but you never know what they’ve knicked and have hidden in their paying members only section.

    Now, it depends how far you want to take this…

    I’ve had magazines use my photos without permission before, and an entertaining incident a little while ago with another photographer who’d done erased the copyright mark from one of my photos and was passing it off as his own. I was not happy…

    Copyright infringement is theft. It’s also a horribly complicated tangle of law too, made worse by the fact that different countries handle it differently – and some countries seem to accept (and even tacitly endorse) wholesale copyright theft.

    I would be inclined to send them a bill. You own the copyright of the photograph and they have used the image without your consent. When one sells a photo what one is *actually* selling is the reproduction right, which should be stipulated in the sale agreement. And they don’t have a sale agreement…

    So I’d bill them for use of the photo – quoting a reasonable going rate. However, you also add (and specifically state what and why) a whopping great administration charge covering the unauthorised use of copyrighted material. And I do mean a whopping fee – maybe 10 times the usage fee.

    If you’ve got a solicitor, give him a copy too…

    Given the track record of these guys, of course there’s every likelihood that they’ll ignore it. And that’s where your decision about how far and hard you’re willing to push this comes into it.

    Sadly I think my solicitor and accountant would be a bit shocked to find out about my little hobby.
    Its not so much the photo I’m annoyed about, its more how they bastardised my logo and branding. That really hurts.
    The hosting service insist isn’t their problem and that would not go by one person’s word, even after sending them the original pdf’s. Surely this should provide enough evidence????

    I hate them. I really do.

    That it a pretty silly reply by a hosting company. Any reputable host would investigate a complaint. It doesn’t take much to set up a hosting re-seller site. You might be complaining to the crook himself. It might be interesting to see if the whois for the hosting provider is the same as the other site. I haven’t had a chance to take a look.
