    Wow! This makes two today for Used Panty University. Nice job Cherie…but, are you sure they call it a “fictitious name” down in your state? “Fictitious” is usually associated with negative, associations “fictitious plates”, “fictitious name”, “fictitious address”, etc. Here in Ohio, the term DBA (doing business as) is used. Regardless, wherever you are, in the United States, you can register as a business with your state as a sole proprietor, partnership, limited liability company (LLC), limited liability partnership (LLP), or a corporation (Inc.). Most of the people here would likely fall under the sole proprietor category, but you can read all about the differences when you get your registration forms. Just go to google and put in your state name and “register a business” or something similar and your state’s web site pertaining to this should come up in the results. (PK aka “dad” talking) Keep in mind though that registering a business is not something to take lightly. There are costs involved, and the paperwork alerts the state that you are selling something, and tells the “tax man” to be looking for tax returns reflecting this business. Also, registrations of businesses are public record and in many cases, you can look it up right on line. A note of caution about the p.o. too, Amy used a P.O. Box when she was selling. Someone sent her a gift and misprinted the box number in the address. When Amy told the guy the gift hadn’t arrived, he called the post office to check on it. When he told them that it was meant for the name Amy sold under, the Post Office employee told him ” that isn’t the P.O. box’s owner, the P.O. box’s owner’s name is…” . Is that what they’re supposed to do? Maybe not, but it does happen.

    On the topic of that panty seller, I really don’t want to say much because some egghead will take it as legal advice. The news article can be found easily in google. Krooze says he knows the lady, so he’d be the best source anyway.

    Just to clear things up, I won an auction from the girl in question before her problems came up. As with most girls I buy from and many I haven’t, I get along well with them. Although she quit selling adult items since her legal issues arose, she occasionally would send me offline messages just to say hi. One time not too long after her legal problems started we chatted for a while.

    I will say that the newspaper article in question was proven to be in error and had the facts all wrong. Sure the guy who got her in trouble was a panty customer but her legal problems had nothing to do with panties. It had to do with some pics on her computer being considered to be pornographic by her community’s standards.

    It’s a shame that article can’t be removed from the internet as it causes way too much confusion! And it’s a shame that community standards are so arbitrary! The pics, as she described to me, would not be considered porno in 90% of the US. Oh well!

    Anyway, I have panty people to meet!!!!

    Thanks for clearing that up Krooze!? Like I said, over here sending anything sexual (and that includes “sending” pictures over the internet) does open one up to prosecution for obscenity.

    And yes PK, in Florida it IS called a fictitious name registration.? It hadn’t even occurred to me that that was odd – I’ve registered a couple of times for different endeavors, but always here in Florida.? ?:laugh:? ?I actually decided to go through with it for this business when a customer sent me a check made out to “Cherie” – which I took to the bank and was told couldn’t be deposited, even though they all have known me for donkey’s years.? I still wouldn’t have bothered if Florida hadn’t recently made it much easier and cheaper to register – used to be you had to take out a big (expensive!) ad in the legal section of the newspsper classifieds, now you just have to fill out a form online, it’s done in 5 min and costs 1/3 as much.? I guess whether you opt to register or not really has to depend on how much business you mean to be doing;? I knew that I wanted to actually make a living doing this stuff and that selling the occasional pair of panties was only going to be the start for me.? ?:)

    Bye the bye, in the process of all this I “came out” as a panty girl/webwhore to the folks at my bank AND a nice young lady at the post office (I have a hard time keeping my mouth shut sometimes, lol!) and none of them even batted an eye – which I take as a reassuring sign that what I’m doing doesn’t “violate community standards.”?

    Try googling for your state and “tax collector,” or check your city’s or county’s website for business links.? Or you could check in the government section of your local phone book and ring up whichever office seems relevant – if they don’t handle such matters they ought to be able to direct you to whoever does.? Many cities and counties have requirements for licenses even for tiny eBay businesses, the only way to know for sure about this is to check.?

    I am nearly certain that no US bank will allow you to open an account under a name that you don’t have some kind of legal documentation for.? I have actually been surprised at how many guys have wanted to pay with personal checks; I too thought they’d prefer something more anonymous.?

    As far as taxes go, keep in mind that a LOT of folks who are doing things that are legally iffy actually get nabbed for tax evasion not obscenity or whatever.? I’d say just keep very close track of your expenses, remembering that lots of stuff you may not have thought of (like haircuts and makeup and banking fees) may qualify as expenses and help to minimize your profits, and therefore taxes.? If you’re just selling a pair here and there you may not show any profit at all as far as the IRS is concerned (this could also work to your benefit if it helps you qualify for something like the Earned Income Credit – but that’s another story).

    If you only intend to sell the occasional pair of panties you might be able to escape the notice of the IRS etc, but if you ever mean to expand I’d say it’s a good idea to get all this stuff straight right from the start, to prevent bigger problems down the road.

    Wow… tons of info. Woot! :ohmy: I really wanted my site up in 2 weeks… but things are looking grim. So much to do and not enough time. Yikes… let me digest all this stuff I gotta do to be safe… with taxes and shipping and such. Wow, seems like a pain in the ass… though hopefully worth it. I wasn’t planning on doing scat and period stuff anyway cause i was worried of health risks to others… so very cool. But pee stuff is ok… or probably best avoided in my case? Lemme think more about the other questons i’m probably gonna have. Oh, yeah… it’s cool to high jack my thread… we all need to know stuff. I’m glad it’s up here for everyone to find.  😉

    When I was first starting out (like, four months ago, LOL) I took a money order to the teller at the bank; it was made out to my real first name and the initial of my last name.  The teller wouldn’t honour it, since it wasn’t my whole real name.  :angry:  When I basically told her, “for fuck’s sake, the m/o is obviously for me, how do I cash it?” she recommended I deposit it through the bank machine where she wouldn’t see the name.  [sheepish look]  That’s what I’ve done ever since…  It has worked fine.  Honestly, once the cheque/money order gets to the processing stage I don’t think the handlers inspect too vigorously…  Unless someone complains, I guess they assume that you are entitled to the funds if you’re in possession of the cheque/money order.  (I was going to use the word “instrument” — as in “financial instrument — but then decided this thread didn’t need a plethora of penis/dildo jokes…  Or does it?  :cheer:)
