Theft?

I’ve seen a new panty site this morning and was dismayed to see that they had ripped off Cindy’s ‘PantyParadise’ site name. 

The new site is called SamsPantyParadise.co.uk (I’ve not left a link because it’s not deserved in my book)

What are the thoughts in the community?

Is it okay for someone to use your site name as their own and potentially poach your traffic?

Will buyers think this Sam is somehow affiliated to Cindy?

Or is it a case of whatever makes you some money quick in this business these days?

How would you feel if someone used YOUR site’s name?

I’ve already contacted the site owner and expressed my dismay at what I see as an attempt to ride Cindy’s popularity for their own gain. It depresses me that despite the help newbie sellers get on here they still feel it necessary to play ‘dirty’.

NB Just thought I should add here that I never saw why sellers got upset at being copied – imitation is the sincerest form of flattery right? Until I saw my work passed of as someone else’s – my blood pressure hit the roof! It’s awful, it’s a horrible feeling and believe me you don’t feel flattered.

Thanks Anna.  I got a few emails last night about it from people who had noticed.  I have since emailed this young lady and she replied she will be changing the name.  If she actually does or not is another matter I guess.  I don’t have any claims or copyrights to that name, but there is such a thing as respect and etiquette, which goes a long way in the community, with both, buyers and sellers.

I would say you do have copyright on PantyParadise Cindy.

Copyright isn’t applied for and granted, it’s automatic. The fact that you have used the words panty and paradise together for such a long time means you do own copyright…unless of course someone can prove that they actually thought of using the two words together first.

I was thinking about this actually .. wondering how other girls might feel if they saw their site name incoporated into a website.

heres a couple I came up with:  Cindysdelishdiscrete.com, Cindyscoderedhead.com, Cindysfetishkitten.com, LadyCindysPanties.com

.. when I did that I realised how much it really sucked LOL … she still has her site up by the way – I didn’t think she would change it and she made up some cock and bull story about most sellers using the term “Panty Paradise”  :laugh: :laugh:… to be honest, the whole site looks fake anyway (not just my opinion either) and probably is just someone attempting to piss me off.  Too funny!

I was thinking about this too. There are LOADS of sellers who use Panty Paradise if you think about it…I think we have been unfair on her.

Oh I regularly use the phrase panty paradise to the extent where I like to drop it randomly into conversation especially when talking to elderly relatives ……

Hi! I finally joined Panty Hog as I felt there are some very important points in this thread that need clarifying.

1. This is not a case of theft.

Theft is permanently depriving another of their property. In this case Sam is not claiming ownership of the phrase PantyParadise and Cindy still has use of it.

2. This is not a case of copyright infringement.

Copyright protects creative or artistic works. It protects your website design and content. It does not protect individual phrases.

Anna is right, you do not have to apply for copyright, it is an automatic right as soon as your work is published.

3. Cindy DOES have the legal right to the phrase “PantyParadise” as a TRADEMARK even though it is not registered. Sam’s use of the phrase is a legal infringement of Cindy’s trademark.

Cindy, PM me if you would like advice on how you can enforce your trademark rights.

Hi Mr E .. thank you.. we all humour these kinds of people but in reality it really isnt very nice.  I shall most certainly be PMing you shortly.  It is good to have someone that knows about this kind of thing. I do hope you stick around, we tend to get ALOT of copyright issues etc
