Now, it depends how far you want to take this…
I’ve had magazines use my photos without permission before, and an entertaining incident a little while ago with another photographer who’d done erased the copyright mark from one of my photos and was passing it off as his own. I was not happy…
Copyright infringement is theft. It’s also a horribly complicated tangle of law too, made worse by the fact that different countries handle it differently – and some countries seem to accept (and even tacitly endorse) wholesale copyright theft.
I would be inclined to send them a bill. You own the copyright of the photograph and they have used the image without your consent. When one sells a photo what one is *actually* selling is the reproduction right, which should be stipulated in the sale agreement. And they don’t have a sale agreement…
So I’d bill them for use of the photo – quoting a reasonable going rate. However, you also add (and specifically state what and why) a whopping great administration charge covering the unauthorised use of copyrighted material. And I do mean a whopping fee – maybe 10 times the usage fee.
If you’ve got a solicitor, give him a copy too…
Given the track record of these guys, of course there’s every likelihood that they’ll ignore it. And that’s where your decision about how far and hard you’re willing to push this comes into it.
ProdromoiMemberI’m still getting all the same problems as before (as per the screenshot). The new format is so messed up for me I’m just going to have to skip the site until it’s fixed.
ProdromoiMemberAnd when I click on “My Mailbox”:
Not Found
The requested URL /newhog/index.php was not found on this server.
Additionally, a 404 Not Found error was encountered while trying to use an ErrorDocument to handle the request.
ProdromoiMemberSo, going by some quick tests people have been doing, it’s currently looking like:
Firefox 2 in Windows – OK
Firefox 3 in Windows – OK
Firefox 2 in Linux Ubuntu 64-bit – format problems
Firefox 2 in Linux Ubuntu 32-bit – format problems
Firefox 2 in Linux Mandriva 32-bit – format problems
Safari on Mac – OK
Firefox 2 on Mac – format problemsInternet Explorer in Windows – TBA
ProdromoiMemberWhile I’m all for trying new things, I’ll let the screenshot largely speak for itself:

Having to scroll to the right hand side of every page to try to read black on dark grey text is not my idea of fun.
Screen resolution is 1280 x 960 by the way.
ProdromoiMember[quote author=wornandwet link=topic=2997.msg19684#msg19684 date=1203480417]i dont think ive met a person without flash enabled ?? ill take my chances. (not trying to be rude)
Just because you’ve not met them doesn’t mean they don’t exist, does it?If I was to look at your pretty flash site I’ll bet that all I’d see would be white boxes. Adobe (who bought out Macromedia, the creators of Flash) don’t support every operating system, so you’re voluntarily shutting out lots of people. But, you take your chances….
ProdromoiMemberI am a man of few words. My input is simply this:
“Please do not feed the troll”…
ProdromoiMemberOne of my favourite quotes:
‘All that is necessary for the triumph of evil, is for good men to do nothing’.
Edmund BurkeProdromoiMemberA little late to this thread, but just to add to the existing comments…
Your site doesn’t present a particularly appealing front to the world. Not everyone on the internet uses the same kind of computer – all I see is a fussy background and lots of empty white boxes; no gallery, no information, no contact details… no nothing. You think that’s going to get you custom?
And on the subject of custom… charging between 25 and 50 AU dollars (roughly 22-44 USD) isn’t just ridiculous, but it’s insulting to potential customers who are smart enough to know better.
ProdromoiMemberActually, avoid using Flash for three reasons…
The third reason is that Adobe does not support every operating system that your viewers will be using, meaning that while you might be seeing a pretty, complicated and Flash-y site, a potential customer might be seeing a blank box…

It may be that the OP expected her initial and surname to be used which would be okay but the ‘buyer’ put ‘Lucy Whatever’…rather that ‘L Whatever’.
“BUT i didnt give my REAL name, the cheque arrived with the made up name i had given him on it. “I remain unconvinced.

I don’t know if you can take your address off now though 🙁Yes, you can. Easily.
So… has no-one wondered exactly how was the OP planning on cashing this supposed cheque having ensured that it was going to have a fake name on it…?
ProdromoiMemberLooks like the video chat room is bust however… we keep getting this message when trying to enter:

ProdromoiMemberI don’t use WordPress as you know, but if I’m right in thinking that you voluntarily deleted your blog (OK, well not totally voluntarily, but as far as WordPress is concerned) then I would expect it to only be totally deleted when you click “Confirm”. Until then I would expect there to be a cancel option.
You might need to cancel it, archive it somehow, then create a new private blog – and then fully delete the WordPress blog.
Bear in mind that since I’m unfamiliar with WordPress, most of that is speculation.
